OOTAY® is a location service aimed at parents who wish to locate their children who have a mobile phone. This service is accessible via Internet and WAP or iMode telephone.
OOTAY® is published by the company Ilico.net. The use of this service is subject to fees paid in form of a subscription. By registering with OOTAY® website, you agree to comply with the present Terms and Conditions of Use. If you do not accept the Terms of Use, you do not need to register with OOTAY® .
Registering with OOTAY® as well as using this site, implies the subscriber’s full acceptance of these Terms. By ticking the designated box "I have read and accept the general Terms and Conditions of Use of OOTAY® services" located at the bottom of the registration page for confirmation, the subscriber acknowledges that he is bound by all the clauses of these Terms and Conditions of use.
In the current general Terms and Conditions of use, the words or expressions beginning with a capital letter signify the following:
OOTAY® signifies parental monitoring services subject to fees and published by the French company Ilico.net.
Service(s) subject to fees(s) signifies all the services available to the subscriber at specific tariffs in British pounds.
Subscriber(s) signifies all the users of OOTAY® services who have paid for the use of OOTAY®
The equipment (computer, software, other means of telecommunication, etc.) that are used for accessing these services are the exclusive responsibility of the subscriber as well as the telecommunication costs incurred by using them.
To become an OOTAY® subscriber, you must complete all the mandatory fields listed in the registration form.
The subscriber agrees to provide true and accurate information about himself. He agrees to notify OOTAY® immediately in the event of any changes in the data he provided during registration and if necessary, proceed to make the changes.
Once the necessary conditions for registration have been met, each subscriber gets a User ID (login) and Password that is strictly personal and confidential, and may not be transferred or shared with third parties. Under no circumstances will OOTAY® be responsible for the loss of the User ID/ or Password by the subscriber.
In the event that the subscriber distributes or uses these features contrary in any way to their end, OOTAY® reserves the right to terminate the subscriber’s account without prior notice.
The subscriber will be solely responsible for the use of these identification features by third parties or the actions or statements made through using his account, whether it be fraudulent or not. He agrees to indemnify OOTAY® against any liability that may arise by reason thereof. In addition, OOTAY® does not have the means to explicitly guarantee the identity of the persons subscribed to this service. OOTAY® will not be responsible in the event of unauthorised use of the identity of a subscriber. If the subscriber has any reason to believe that someone is using his identification features or his account, he must notify OOTAY® immediately.
To register you must pay with your Credit Card for subscription of 3 (three), 6 (six) or 12 (twelve) months. The subscriber will then be able to access OOTAY® services. The prices and the modes of payment of the service are available not later than during provision or the use of the service.
As part of the use of service, the subscriber expressly agrees to comply with the following rules :
Without prejudice to the provisions of the article on "Cancellation", in the event of breach of one or more of these rules, OOTAY® reserves the right to stop the account of the subscribers involved temporarily or permanently without remuneration or reimbursement.
OOTAY® cannot be held responsible for misrepresentations made by a subscriber and disclaims any and all liabilities for fraudulent locations.
OOTAY® does not guarantee the accuracy of the locations (the accuracy depends on the network of the mobile phone operators).
As a condition of use of this site, it is assumed that the subscriber has paid for subscription to the service for 3 (three), 6 (six) or 12 (twelve) months to locate 1 (one) child. Subscribers can pay with his Credit Card on this website. You can access the price and modes of payment of the service not later than during provision or use of the service.
All prices quoted are in £ inclusive of all taxes.
OOTAY® conforms with the strictest privacy standards.
Each subscriber can access or request access to information concerning him in order to make changes or to delete it by writing to the following postal address : ilico.net – 25 rue Caillaux - 75013 Paris - France, via email by completing the contact form ; and not forgetting to indicate his personal User ID.
The personal information OOTAY® collects may include your name, postal address, email address and mobile phone number.
Furthermore, we may also collect some non-personal information such as the subscriber’s browser version or that of all Users (Netscape, Internet Explorer, etc.), the type of operation system used (Windows 98, Mac OS, etc.) and the IP address of the computer used.
OOTAY® cannot function without cookies used for storing the identifying information of the subscriber during his visit to OOTAY® so that he does not need to enter it manually on each page consulted. The subscriber may however prevent the use of cookies at any time by modifying the options of his internet browser software.
The information we collect concerning you during registration on OOTAY® is used to provide you with our service. We take all the necessary precautions in our database to store your information in a secured environment. Only specific employees of ours have access to your information, which is only available to them in case of need. The personal information provided during your registration will not be accessible to third parties, transferred, sold or exchanged.
The trade marks, logos, graphics, photographs, animations and texts contained on OOTAY® website are the intellectual property of Ilico.net and may not be reproduced, used or represented without explicit authorization by Ilico.net and violation will result in legal action.
The rights of use granted to the subscriber by OOTAY® are strictly limited to access, downloading, printing, reproduction on any supporting material, (hard disc, CD-ROM, etc.) and the use of the documents for private and personal use within this scope and for the period of membership with OOTAY®. Any other use by the subscriber without authorization by Ilico.net is prohibited.
The subscriber is expressly prohibited from modifying, copying, reproducing, downloading, sending, transferring, trading or distributing of any kind, whether it be the services, OOTAY® website pages or the computer codes of the features that constitute OOTAY services as well as the site.
Every subscriber can cancel his registration with OOTAY® at any time and without reason in the section of OOTAY® website reserved for this purpose. The unused location credits by the subscriber at the moment of cancellation of his membership with OOTAY® will not be refunded.
Without prejudice to other provisions of the current Terms and Conditions, in the case of breach of these Terms and conditions of use by the subscriber, OOTAY® reserves the right to suspend or cancel the account of the subscriber without prior notice, refund and/or take legal action against him.
This cancellation will involve ipso jure and without prejudice any damages and interests that may be claimed by OOTAY® in compensation for any loss suffered as a result of such violations.
The subscriber will be notified of the cancellation or the confirmation of cancellation of his account via email. The data concerning the subscriber shall be destroyed following the cancellation of the subscriber’s account.
1. The information provided by a subscriber to OOTAY® must be true and accurate. The consequences of its disclosure on his life and/or that of other subscribers are the exclusive responsibility of the subscriber concerned. The subscriber waives any claim against OOTAY®, especially for any reasons due to possible breach of his rights to the protection of his reputation and his privacy as a result of distributing or disclosing information pertaining to him as stipulated in these Terms, notably in Article 5 " Data Protection and Privacy of the subscriber".
2. Where a claim is made against OOTAY as a consequence of a Subscriber’s infringement of obligations imposed on said Subscriber by law or of these Terms and Conditions of Use, the latter agrees to hold OOTAY harmless from and against any verdict delivered against him. The agreement shall cover all possible expenses such as legal costs and lawyer’s fees that might have to be borne by him.
The subscriber must have the competence, materials and software required for internet use or as the case may be, internet services, audiotel or SMS telephony and acknowledge that the internet characteristics and limitations do not allow the guarantee of security, the availability and the integrity of transmission of data on the internet.
In these Terms and Conditions, OOTAY® does not guarantee that the services will function without interruption or functional error. The operation in particular may be temporarily interrupted due to maintenance, updates or technical improvements or for developing the content and/or its presentation. Whenever possible, OOTAY® will inform its subscribers beforehand of a maintenance operation or update. The subscriber waives his rights to seek to establish the liability of OOTAY® with regard to the functioning and operation of the services.
Likewise, OOTAY® cannot be held responsible for the non-functioning, for problems with access, or for poor conditions of use of OOTAY website attributable to non- compatible equipment, for the internal problems with the access provider of the subscriber, for the clogging of internet networks and for any reasons beyond OOTAY®.
OOTAY® may provide or third parties may include links to other websites or other internet sources. In so far as OOTAY® cannot monitor the websites and the external sources, it cannot be held responsible for the availability of the websites and external sources and it cannot hold any responsibility with regard to their content, advertisements, products, services or any other feature available on or from the websites or external sources. Any problems concerning a link must be forwarded to the Administrator or Webmaster of the site in question. In addition, bear in mind that the visit and/or use of the sites and external sources are governed by their own Terms and Conditions of Use. Finally if in the scope of a search performed on OOTAY® website the result thereof leads the subscriber to link to websites, pages or forums in which the subject and/or the content constitutes a violation of French laws, the subscriber shall be requested to cease visiting the website in question to avoid personal liability.
Under any and all circumstances, OOTAY® ’s comprehensive liability is limited to the amount actually paid by the subscriber for the failure of service.
OOTAY® will not be responsible in any event for damages indirectly suffered by the subscriber including the loss of data (including copies) or registrations made by the subscriber. The subscriber is responsible for making backup copies. Article 9. AGREEMENT BETWEEN THE SUBSCRIBER AND OOTAY® These Terms of Use as well as OOTAY® website as referred to in the agreement constitute a contract governing the relationship between the subscriber and OOTAY® . It annuls and replaces any previous provisions not expressly stated or added and constitutes all the rights and obligations of OOTAY® and the subscriber.
OOTAY® reserves the right to modify or develop the pages of OOTAY® website, services, prices or applicable Terms and Conditions. The changes will go into effect once they are published online on OOTAY® website, without prejudice to the rights of any subscriber to cancel his membership with OOTAY® . In the absence of this, the subscriber is deemed to have accepted the modifications by continuing to use OOTAY® website or services. The subscribers are therefore requested to refer to the latest online version on the website. The presence of the subscriber on the website implies that he fully accepts any revision or modification.
These Terms and Conditions of Use are governed, interpreted and applied in accordance with British laws. The English courts shall have exclusive jurisdiction over all disputes related to these Terms including, without limitation, its validity, its interpretation, its execution and/or its cancellation and the consequences thereof.
